The Philippine Laws Governing Apartment Rentals
There are two major laws that cover rental policies in the Philippines. The first one is the Republic Act No. 9161 or the Rental Reform Act of 2002, which is the leading law that regulates rentals of certain residential units in the country. The second one is the Republic Act No. 9653 or Rent Control Act of 2009, which applies to residential units having rental payment ceilings.
In RA 9161, it is provided that the rental fee must be paid in advance during the first five days of the month or the start of the lease agreement unless otherwise indicated. The lessor cannot demand for more than a month of advance rental and two month’s worth of deposit. Assignment of lease or subleasing of the whole or any portion of the residential unit is also prohibited. This includes the acceptance of boarders or bedspacers without the written permission of the owner/lessor. Under RA 9653, the requirements for rent and deposit expand coverage on failure to pay the rental payment and other fees stated in the lease contract. The Act provides that whatever interest that accumulates must be returned to the lessee at the end of the lease contract. If the lessee, however, was not able to settle rent or utility bills like electric, telephone, and water, or damaged any object in the property, the deposits and interests will be forfeited in favor of the owner in the amount equal to the cost of the damage.
Per RA 9653, the annual increase of the rent after December 31, 2013, should be not more than 7 percent of the rent, provided that the unit is still being rented out by the current lessee. More so, if the residential unit becomes vacant, the lessor has the right to give a new rate for the succeeding lessee.

With its monthly rate of PHP 4,800 per person per month and inclusive of association dues, the bed space comes inclusive of free use of the complex’s swimming pool, fitness gym, and tennis court. The unit has no air-conditioning but electric fans are provided. TV with cable, cabinets, stove, refrigerator, and a dining set are also included. The apartment is close to several laundry shops, fast food chains, cafeterias, barber shops, computer shops, and water refilling stations. The lease contract is 12 months with a required two-month deposit. Deposit shall be forfeited if the 12-month contract is voided.
